ACCEPTANCE OF TERMS
By accessing or using this website, including obtaining quotes, applying for insurance, binding coverage or renewing policies, you agree to the Terms of Use and our Privacy Policy.
If you do not agree, you must not use this site.
Advantage Flood may update these terms at any time. Continued use of this site constitutes acceptance of revised terms.
SEVERABILITY
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
ADVANTAGE FLOOD’S ROLE; NO INSURANCE ASSUMED
Advantage Flood is a licensed Managing General Agent (“MGA”) and program administrator.
Advantage Flood: Underwrites and Administers flood insurance programs: acts on behalf of one or more authorized Surplus Lines Carriers and DOES NOT assume underwriting risk.
ALL INSURANCE POLICIES ARE ISSUED BY THE APPLICABLE INSURANCE CARRIER IDENTIFIED IN YOUR POLICY DOCUMENTATION. THE ISSUING CARRIER ALONE ASSUMES THE INSURANCE RISK.
SURPLUS LINES DISCLOSURE
Insurance products made available through this Site are placed with surplus lines insurers.
Surplus lines insurers:
- Are not licensed in every state;
- Are not subject to the same rate and form regulation as admitted insurers; and
- May not be protected by state insurance guaranty funds.
Applicable surplus lines disclosures required by your state of residence are included in your policy documentation.
QUOTES AND APPLICATIONS
Quotes generated through the Site:
- Are estimates based on information provided by you and available third-party data;
- Are subject to underwriting review;
- May be revised if information is inaccurate, incomplete, or changes prior to binding; and
- Do not constitute binding coverage.
Applicant represents and warrants that all information submitted is true, accurate, and complete. Material misrepresentation may result in rescission, cancellation, or denial of claims as permitted by law and by the terms of the policy.
BINDING OF COVERAGE
Coverage is not bound unless and until:
- You complete the required application process;
- Underwriting approval is granted, if required;
- Required premium payment is successfully processed; and
- Written confirmation of binding and/or policy issuance is delivered.
The effective date and time of coverage are stated in the issued policy. System availability, quote displays, or payment submission alone do not create binding coverage.
POLICY CONTROLS
In the event of any conflict between information on this Site, marketing materials, quotes, summaries, confirmations, other communications, or these Terms of Use, and the issued insurance policy, the terms, conditions, exclusions, endorsements, limitations, cancellation provisions, and all other provisions contained in the issued insurance policy shall control in all circumstances.
No statement on the Site modifies, expands, or reduces any insurance policy.
AUTOMATIC RENEWAL
Certain policies may automatically renew at the end of the policy term unless you provide notice of non-renewal prior to the renewal date or the issuing carrier elects not to renew in accordance with applicable law and policy terms.
Renewal premium, eligibility, and terms may change at renewal.
If you enroll in automatic payment, you authorize Advantage Flood [and/or the issuing carrier] to process renewal premiums using your designated payment method unless you cancel such authorization prior to renewal.
All renewals remain subject to the terms and conditions of the policy.
CANCELLATION AND REFUNDS
Cancellation rights, procedures, effective dates, and any premium refunds are governed exclusively by the terms of the issued insurance policy and applicable law.
The Site does not create any independent right to cancellation or refund, nor does it modify any cancellation or refund provisions contained in the policy.
ELECTRONIC TRANSACTIONS AND CONSENT
By using the Site, the user consents to conduct transactions electronically, receive disclosures, notices, renewal offers, and policy documents electronically, and use electronic signatures. Electronic records satisfy any requirement that communications be in writing, to the extent permitted by law. The user is responsible for maintaining accurate and current contact information.
WEBSITE AVAILABILITY AND THIRD-PARTY DATA
Advantage Flood does not guarantee uninterrupted availability of the Site.
Quotes may rely on third-party data sources, including property characteristics, geospatial information, elevation data, and public records. Neptune does not guarantee the accuracy of such data.
The user remains responsible for verifying submitted information.
INTELLECTUAL PROPERTY
All content, underwriting logic, software, design, trademarks, service marks, and proprietary materials on the Site are owned by or licensed to Advantage Flood and protected by applicable intellectual property laws.
Users may not reproduce, reverse engineer, scrape, modify, or distribute Site content without prior written consent.
DISCLAIMER OF WARRANTIES
The Site is provided “as is” and “as available.”
To the fullest extent permitted by law, Advantage Flood disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of content.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Advantage Flood shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damage arising from use of or inability to use of this Site, reliance on quotes or summaries, electronic transmission failures, or temporary system unavailability.
Nothing in these Terms limits liability where such limitation is prohibited by law.
GOVERNING LAW
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles.
